Terms and Conditions

This page contains Dorset Patchworks' general Terms and Conditions.

These Terms and Conditions apply to all transactions between Dorset Patchworks and you, the customer.  The Terms and Conditions do not affect your statutory rights.  Please read them carefully.

We reserve the right to change the Terms and Conditions at any time. Any changes will take effect on the date they are posted on Dorset Patchworks' website.  These Terms and Conditions are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. 

ORDERS

We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

Ordering goods may be done on our website.   We will acknowledge all orders electronically by e-mail.  Please note that verbal and/or electronic acknowledgements do not constitute order confirmation or order acceptance.  In the event that you have made an error in your order you must take reasonable steps to correct such error in a timely manner.  Once we accept your order a legally binding contract between you and us will take place once the goods have been dispatched or collected.  If we are unable to fulfil your order for any reason we will inform you by email or by telephone as quickly as is reasonably practicable.

Relevant statute requires that certain information or communication we send to you should be in writing.  In the circumstances, when you use our site, you accept that communication with us will be mainly  by electronic means.  For contractual purposes, you agree to this.  Further, you agree that all contracts and information and any other communication we provide to you electronically complies with our legal requirement that such communications be in writing.

PRICES

The total price payable will be stipulated at the time you place your order, whether or not the order has been acknowledged.  We reserve the right to adjust the price to reflect any increase in our suppliers' prices, or in respect of any tax or duty which we are required to levy, or if there is an error in or omission of the price for goods appearing on our website or for any adjustment which may be required due to postage costs.  We will inform you of the correct price and give you the opportunity to cancel the order.   Dorset Patchworks is not registered for VAT purposes.

MAKING A PAYMENT

All prices are shown in Pounds Sterling.  When you wish to make a purchase simply click on any item(s) you would like to purchase to put them into the shopping basket.  Once you have finished click on 'Order'.  Postage costs will be included in the total price and you will then need to complete the checking out process.

- Orders over £20.01 and below £50.00 are £4.60

- Orders over £50.01 and below £100.00 are £6.75

- Orders over £20.01 and below £35.00 are £6.25

- Orders over £35.01 and below £100.00 are £10.00

Royal Mail Special Delivery Guaranteed by 1pm

Orders under £50.00 are £10.00

PLEASE NOTE:  ORDERS SENT BY ROYAL MAIL FIRST CLASS OR ROYAL MAIL SIGNED FOR FIRST CLASS ARE ONLY COVERED UP TO A LIMITED VALUE.  FOR ADDITIONAL PROTECTION FOR ORDERS IN EXCESS OF £50 IT IS RECOMMENDED THAT YOU SELECT THE ROYAL MAIL SPECIAL DELIVERY SERVICE.

 

For particularly heavy or bulky items, Parcel Force express48 may be used.  Delivery times for mail sent by first class mail is between 1 to 3 days and for Parcel Force express48 the delivery time is estimated to be 2 working days.  Dorset Patchworks cannot be held liable for these estimates and they should be used as a guide only.

Dorset Patchworks reserves the right to notify you in the event that the postage is significantly higher than the postage rate appearing at the checkout stage due to the weight or size of the order.  Dorset Patchworks will in these circumstances email you with details of the amended cost of postage and will only proceed with the order upon receiving confirmation from you in writing (this may be communicated by email) that you accept the amended postage rate.

Dorset Patchworks will accept orders from countries in Europe Zones 1, 2 and 3 and in World Zones 1, 2 and 3 as listed below.  Orders to those countries will be sent using Royal Mail International Tracked & Signed or Parcelforce Worldwide.

Republic of Ireland, France, Germany, Denmark, Monaco, Corsica

- Orders under £10.00 are £13.35

- Orders over £10.01 and below £50.00 are £15.00

- Orders over £50.01 are £15.50

Europe Zone 2:

Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Estonia, Finland, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden

- Orders under £10.00 are £14.75

- Orders over £10.01 and below £50.00 are £15.90

- Orders over £50.01 are £17.45

Europe Zone 3

 Andorra, Georgia, Iceland, Liechtenstein, Moldova, Norway, Switzerland, Ukraine 

- Orders under £10.00 are £15.95

- Orders over £10.01 and below £50.00 are £16.70

- Orders over £50.01 are £19.20

The cost of postage to World Zone 1 countries listed below is as follows:-

 Canada, Hong Kong, Israel, Japan, South Africa

 - Orders under £10.00 are £22.40

- Orders over £10.01 and below £35.00 are £25.30

- Orders over £35.01 are £30.20

World Zone 2

The cost of postage to World Zone 2 countries listed below is as follows:-

Australia, New Zealand and Singapore

- Orders under £10.00 are £24.85

- Orders over £10.01 and below £35.00 are £28.10

 - Orders over £35.01 are £35.80

World Zone 3

The cost of postage to World Zone 3 country listed below:

United States of America

- Orders under £10.00 are £24.70

- Orders over £10.01 and below £35.00 are £27.65

- Orders over £35.01 are £31.85

 

Delivery times for overseas destinations are variable.  For European destinations estimated delivery is between 2-11 working days and for countries in World Zones 1, 2 and 3 (as listed above) the estimate is 3-11 working days.  Dorset Patchworks cannot be held liable for these estimate and they should be used as a guide only.

If your country is not listed within the World Zones, please contact us and we will provide an estimate.

Dorset Patchworks will obtain additional compensation cover from Royal Mail if requested by you.  Please contact Dorset Patchworks for details of the cost of such additional compensation cover.

Dorset Patchworks will obtain proof of postage.

Dorset Patchworks reserves the right to notify you in the event that the postage to your chosen destination is significantly higher than the postage rate due to the weight or size of the order.  Dorset Patchworks will in these circumstances email you with details of the amended cost of postage and will only proceed with the order upon receiving confirmation from you in writing (this may be communicated by email) that you accept the amended postage rate.

Dorset Patchworks will not accept orders from customers where a delivery address is a PO Box.

If you provide us with incorrect delivery details which results in non-delivery of your order or the return of your order we reserve the right to charge additional postage to re-send your order to the correct address.

 

DUTY PAYMENTS AND CUSTOMS

 

Products delivered to some destinations overseas may be subject to taxes, fees, levies or other charge.  The recipient of goods sent by Dorset Patchworks to an overseas destination is responsible for any import duty, taxes or otherwise which may be payable.  Dorset Patchworks has no control over such charges and cannot be held liable for any such duties.  If you require information about import duties you should contact your local customs office for further information before placing an order.

 

CANCELLATION AND REFUNDS POLICY

Right to Cancel

You have the right to cancel this contract within 14 days without giving reasons.

The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise your right to cancel, you must inform us, Dorset Patchworks, 41 St Andrew's Road, Bridport, Dorset DT6 3BJ, Tel:  07765 355669, email: [email protected] of your decision to cancel this contract in a clear statement (e.g. a letter sent by post or by email).  Upon receipt of your request to cancel we will communicate to you an acknowledgement of receipt of such a cancellation on a durable medium (e.g. by email) without delay.  You may use the wording on the following model cancellation form, but this is not obligatory:

You must provide your name, geographical address, details of the order you wish to cancel and, where available, your telephone number and email address.  To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.  To exercise your right to cancellation, you are obliged to retain possession of the goods and take reasonable care of them and then return the item(s) within 14 days of providing written confirmation of your request to cancel your order..  The cost of returning goods is at your expense and it is recommended that returned goods are sent by 1st class registered post, or an alternative secure method, for your own protection.  Dorset Patchworks cannot be held liable for items that are mislaid or damaged in the post.

Effect of cancellation

If you cancel this contract, we will reimburse to you all payments received from you.  It does not include the cost of returning the goods to us, which is your responsibility.

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you any goods supplied.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.  We will withhold reimbursement until we have received the goods back.

Your right to return products does not apply to items made to your specification or that have been personalised.  Any goods that have a manufacturing defect will be replaced or refunded.

These Terms and Conditions do not affect your statutory rights.

COMPLAINTS

We hope that you will be entirely satisfied with any goods purchased from us but in the unlikely event you have a complaint this should be addressed to Dorset Patchworks, 41 St Andrew's Road, Bridport, Dorset DT6 3BJ.

COLOUR REPRESENTATION

The colours of products appearing on our website are a close representation and are as accurate as is reasonably practicable.  We cannot accept responsibility for any variation in colour caused by browser software on customers' computers.

CARE INSTRUCTIONS FOR QUILTS

Unless otherwise stipulated in the item description, all our patchworks and quilts for sale are handmade using a domestic sewing machine and finished by hand.  We recommend that our quilts be handled with care.  The quilts may be washed with like colours on a gentle cycle and line dried or in a tumble drier on a cool setting.  Some shrinkage is to be expected (in the region of 5-7%).  Fabric used to make the patchworks and quilts is not pre-washed by Dorset Patchworks, unless otherwise indicated.

This Privacy Policy describes how and when we collect, use, and share information when you purchase an item from us, contact us, or otherwise use our services and does not apply to the practices of third parties that we do not own or control.

To fulfil your order, you must provide us with certain information such as your name, email address, postal address, payment information, and the details of the product that you are ordering.  You may also choose to provide us with additional personal information (for a custom order, a patchwork quilt for example), or if you contact us directly. If we don’t collect your personal data during checkout, we won’t be able to process your order and comply with our legal obligations.   For example, your details may need to be passed to a third party to supply or deliver the product that you ordered and we may keep your details for a reasonable period afterwards in order to fulfil any contractual obligations such as refunds.

Cookies are used on this shopping site where they are strictly necessary for the site functionality. They are used to aid navigation, and to keep track of the contents of your shopping cart

We secure access to all transactional areas of our website and apps using ‘https’ technology.

5. The length of time we keep personal information

Data Retention

Whenever we collect or process your personal data we will only keep it for as long as is necessary for the purpose for which it was collected.

At the end of that retention period, your data will either be deleted completely or anonymised, for example by aggregation with other data so that it can be used in a non-identifiable way for statistical analysis and business planning.

For orders, we will keep the personal data you give us for four years so we can comply with our legal and contractual obligations.
